Beginning in March, the Association has filed a long series of Freedom of Information Act requests with the City, requesting all public records relating to Dick Ashe’s proposed development and rezoning of the golf course. The City and Mr. Hildebrandt have consistently failed to produce all of the relevant documents related to Ashe's rezoning and development efforts, and the Association has repeatedly directed its attorneys to attempt to cooperate with the City by sending a series of follow-up letters.

After four letters from the Association, in addition to multiple e-mails and telephone calls, the City still has not provided the relevant documents, some of which we know without question exist (because we've obtained them from other sources). Therefore, in order to effectively serve the interests of the Kiln Creek residents -- over 90% of whom oppose Mr. Ashe's development efforts according to our last survey -- the Association was left with no choice but to file suit, seeking the immediate turnover of all documents related to the rezoning and development, as well as the recovery of the attorneys’ fees expended in bringing the suit.
